1. Agreement

These Terms of Service ("Terms") govern your access to and use of the Niqati ("نقاطي") website, mobile applications, dashboard, APIs, and related services (the "Service") provided by Niqati. By creating an account or using the Service, you agree to these Terms.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create a Niqati account. By using the Service you confirm you have the legal capacity to enter into a binding agreement.

3. Accounts

• You are responsible for the accuracy of the information you provide.
• You are responsible for maintaining the security of your credentials.
• Notify us immediately at support@niqati.com of any unauthorized access.

4. Acceptable use

You agree not to:

• Use the Service for unlawful, fraudulent or harmful purposes.
• Attempt to reverse engineer, disrupt, or overload the Service.
• Upload content that infringes intellectual property or violates Saudi law.
• Send unsolicited or deceptive communications via Niqati.
• Misuse loyalty mechanics (e.g., generating fake points or redemptions).

5. Merchants & loyalty programs

Merchants using Niqati to operate loyalty programs are solely responsible for:

• The accuracy of their offers, points, stamps and rewards.
• Honoring redemptions according to their published rules.
• Compliance with applicable Saudi consumer protection and tax laws.

Niqati provides the technology platform; the loyalty offer itself is the merchant's responsibility.

6. Pricing & payments

Some features are paid. Pricing is displayed in Saudi Riyal (SAR) and may change with prior notice. Subscriptions renew automatically unless cancelled. Taxes (e.g., VAT) apply where required by Saudi law.

7. Intellectual property

The Niqati name, logo, design, and software are owned by Niqati and protected by intellectual property laws. You receive a limited, non‑exclusive, non‑transferable license to use the Service in accordance with these Terms.

8. Privacy

Your use of the Service is also governed by our Privacy Policy.

9. Termination

You may stop using Niqati and delete your account at any time from Settings → Account → Delete Account. We may suspend or terminate accounts that violate these Terms, abuse the Service, or pose a security risk.

10. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by Saudi law, Niqati disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement.

11. Limitation of liability

To the maximum extent permitted by law, Niqati's total liability for any claim arising out of or relating to the Service shall not exceed the amounts you paid to Niqati in the twelve (12) months preceding the claim.

12. Governing law

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Disputes shall be resolved before the competent courts of the Kingdom of Saudi Arabia.

13. Changes

We may update these Terms from time to time. Material changes will be communicated through the app or by email. Continued use after changes constitutes acceptance.
